Participant Waiver & Release of Liability

IMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING

By participating in a guided tour with South Point Off-Road Tours LLC, you acknowledge and agree to the following:

1. Assumption of Risk

I understand and accept that riding in an off-road Jeep or any 4x4 vehicle on uneven, rugged, and unpredictable terrain involves inherent risks, which may include, but are not limited to:

• Bumps and jolts that may cause accidental impact with interior surfaces such as windows or roof handles

• Sudden movements that could lead to minor personal injury, such as biting my tongue, bumping knees or elbows

• The possibility of tripping or falling when entering or exiting the Jeep, which may require a ladder or step due to the modified height of the vehicle

• Failure to follow safety instructions, including the required use of seat belts at all times during the tour, may increase the risk of injury and is the responsibility of each participant

• Natural elements including dust, mud, water, and unpredictable wildlife

• The inherent risk of travel through remote or undeveloped terrain, which may limit immediate access to emergency assistance

I also understand that participating in Jeep tours and camping activities involves additional inherent risks including, but not limited to: rough terrain and off-road driving, exposure to wildlife, insects, and unpredictable weather, possible slips, trips, or falls, campfires and natural hazards, and limited access to medical services in remote areas.

These risks are part of the experience and cannot be entirely eliminated without changing the nature of the tour or camping event.

2. Food and Beverage Policy

I acknowledge that I am responsible for providing my own food and beverages for the duration of the tour or camping trip. South Point Off-Road Tours LLC will only provide water.

I understand that I am solely responsible for the safe storage, preparation, and consumption of my food. I will take precautions to avoid attracting wildlife, including proper storage of food and waste.

I release South Point Off-Road Tours LLC, its owners, guides, and affiliates from any liability related to foodborne illness, allergic reactions, or mishandling of food and beverages brought by myself or other participants.

As part of the tour experience, South Point Off-Road Tours LLC may, as a courtesy or as part of the itinerary, suggest or bring guests to local restaurants or food establishments. While we aim to offer enjoyable and reputable options, we are not responsible for the quality, preparation, or safety of food or beverages consumed at these third-party establishments, and we assume no liability for any illness, allergic reaction, or negative outcome that may result from such consumption.

3. Wildlife and Environmental Acknowledgement

I understand that tours and camping take place in natural, outdoor environments where wildlife is present.

I agree to: follow all safety instructions provided by guides; not feed, provoke, or approach any wild animals; properly dispose of all food waste and trash; and accept personal responsibility for any consequences of my interaction with wildlife or failure to follow safety practices.

This responsibility applies both on foot and while inside the Jeep or any 4x4 vehicle, as wildlife encounters can occur unexpectedly even while seated or in transit.

4. Medical Conditions & Preparedness

I affirm that I am physically and mentally fit to participate and have disclosed any medical conditions that may affect my safety or the safety of the group.

I understand that emergency response times may be delayed due to the remote and rugged nature of certain tour locations, which may limit access to immediate medical assistance or transport.

I am solely responsible for bringing any personal medications, medical devices, or health-related items I may require during the tour or camping experience. This includes, but is not limited to: inhalers, epinephrine (EpiPens), insulin, or other prescribed medications.

I understand that the possession or use of cannabis (including medical cannabis), recreational drugs, or any illegal substances is strictly prohibited during all South Point Off-Road Tours activities, regardless of state-level legalization. Violation of this policy may result in immediate removal from the tour without refund and, if necessary, notification of local authorities.

5. Personal Responsibility

I certify that I am physically able to participate in this activity. I agree to follow all instructions given by the tour guides and to exercise reasonable caution throughout the tour experience.

I am responsible for securing my belongings, remaining seated while the vehicle is in motion, and using handholds or safety aids when entering or exiting the Jeep or any other 4x4 vehicle.

This includes any transportation provided, owned, or recommended by South Point Off-Road Tours LLC, such as shuttle vans, trams, or third-party vehicles that may be part of the tour logistics. I acknowledge that the same safety expectations apply across all vehicles involved in the experience.

6. Waiver of Liability

In consideration of being permitted to participate in this activity, I hereby voluntarily release, waive, and discharge South Point Off-Road Tours LLC, its owners, employees, and affiliates from any and all liability for injuries, damages, or losses sustained as a result of participation in this activity, whether caused by negligence or otherwise.

This includes, but is not limited to, claims related to bodily injury, property damage, or emotional distress arising from participation in the tour or any activity.

7. Agreement to Indemnify

I agree to indemnify and hold harmless South Point Off-Road Tours LLC from any claims, lawsuits, or damages brought by myself or any third party arising from my participation.

8. Photo/Video Release 

I grant South Point Off-Road Tours LLC permission to use photos and videos taken during the tour that may include my image, for promotional purposes across digital and print media.

9. Booking Acknowledgment & Refund Responsibility

I understand that all bookings with South Point Off-Road Tours LLC are non-transferable. By reserving a tour or camping experience, I acknowledge that my spot is held exclusively for me and cannot be reassigned.

I understand that I may cancel my reservation for a full refund if I notify the company at least 72 hours before the scheduled start time. Cancellations made less than 72 hours in advance or failure to show up for the tour will result in the forfeiture of payment.

South Point Off-Road Tours LLC reserves the right to cancel or modify tours at any time due to weather, safety concerns, or other unforeseen circumstances. In such cases, guests will be offered either a reschedule or a full refund, at the company’s discretion.

I acknowledge that no cash refunds will be issued, and I agree to arrive on time, fully prepared, and informed of all safety and participation requirements provided prior to the tour.

10. Minimum Age Requirement

I acknowledge that all participants must be at least 6 years old on the day of the tour. This policy is in place to comply with Florida child restraint laws and to ensure the safety of all guests in off-road conditions. I understand that South Point Off-Road Tours LLC does not accommodate children under age 6, and failure to meet this requirement will result in denied participation without refund.
